Legal Question in Landlord & Tenant Law in California

We have tenants renting our cottage and they pulled up all of the old wood from our deck and promised to get rid of it a month ago. The guy who is renting the cottage also kicked in the door to the cottage and broke it. We gave them an eviction notice but is there anything else we can do to ensure they pay for the damages and their mess before they move?

As long as they are in lawful possession there is nothing you can do except for make sure you have all the information you will need to collect any judgment you may get - bank accoun numbers friends family numbers etc.... I hope you did a walk through before they moved in and took photos. The only thing you can doat this point is to post a 24 hour notice to enter and inspect the premises for damage. That way you can at lease document the condition while theyare still there. If the damage rises to the level of destruction of walls and doors and windows - I would call the police on a domestic disturbance call - you can't call on domestic violence unless that is what s going on- and you can't call on vandalism while they are still legally in possession. The police reprts would at least support your claim of vandalism or additional damages that a court could award.
