Legal Question in Landlord & Tenant Law in California

tenants rights

We had a date specific lease that terminated 7/31/06. We vacated the premises on that date but did not turn in keys until 8/14/06. Property mgt. co. never offered a walk through prior to lease end. We never received a dispostion of our deposit. 3/07 we were served w/papers that we're being taken to small claims for back rent, paint, carpet cleaning & damages. What are our rights and do we have any recourse?

Thanks for your help!

Re: tenants rights

It depends on what you communicated to your landlord about whether you were out of the apartment. I think if it's only the keys you didn't turn in, but your landlord knew you were gone, the landlord had an obligation to account for and return your deposit. You might file a cross-complaint for return of your security deposit.
