Legal Question in Landlord & Tenant Law in California

trespassing mother in law?

My spouse and I got separated. We have no separation agreement yet. My life occasionally lives with he rnew boyfriend. My wife asked her mother to come over and live with us in this interim period. She's been with us for 3 months. I asked her to leave but she won't. Can she legally stay? Will she be considered a trespasser if I file a complaint to the police?

Re: trespassing mother in law?

No, you cannot have a guest of an owner of the property removed, except by a restraining order for violence. However, you could ask the court to require your wife to pay you 1/2 the rental value of the premises her guest is using without your permission.
