Legal Question in Legal Ethics in California

Dre license renewal issue

I failed to disclose a misdemeanor conviction from 1993 to the DRE. Subsequent to that time, I have renewed my real estate license twice. The guilty plea was to ''attempted'' DUI (a novel plea!).

How may I correct this 'inadvertence,' short of disclosing the conviction on my next license renewal form and thereby subjecting myself to possible sanctions by the DRE?

Re: Dre license renewal issue

Honesty is a great policy. If you write a letter to the DRE and disclose the situation voluntarily, I can't imagine them punishing you. If you simply forgot to include the information and have realized it recently, the best policy is to come forward. If you wait until some event prompts you to talk about it, you'll look much more dishonest.

It's a crapshoot, but if I were you, I would write a letter and get in the mail pronto. Just stress that your failure to report it was an innocent oversight and NOT an attempt to deceive or withhold information.
