Legal Question in Legal Ethics in California

Privacy Rights and video

I got into an argument with a hotel clerk at a Hotel 6 about room service (I didn't get any). I wanted to get a discount on the rate for one night. He refused and said they have up until 12 midnight to clean the room. I pulled out my camera phone and started to video tape him and asked him to repeat that so I could record him. He asked me if the video was working and I told him it was. He then jumped over the counter and physically revealed me of my phone to stop it from recording. He gave back the phone immediately after. Who was assaulted: me or him?

Were you injured? No!

Did you suffer damages, other than hurt feelings? No!

Forget it, and move on.

Oh, you both assaulted each other.
