Legal Question in Legal Malpractice in California

Where do I file legal malpractice?

I want to file against my attorney for malpractice.

Where do I file my case at? I now live about 60 miles

away from the attorney office. Do I have to file

at his place or at my current residence?

Thank you.

Re: Where do I file legal malpractice?

You would have to file in the county where the services were provided or the agreement was entered into -- usually the county where the attorney practices. In general, legal malpractice cases can be very complicated because not only will you have to prove that the attorney messed up, but that you would have won in the underlying civil case, or that you would not have been convicted in the criminal case but for the attorney's malpractice. It might be worth your while to have an attorney you trust review the case with you to give you legal input.
