Legal Question in Medical Malpractice in California

Mom was having breathing problems at home, so we called an ambulance which took her to the local hospital. After stabilizing her, the hospital discharged her to Astoria Nursing and Rehab Center, where she remained for three weeks. She went into full cardiac arrest and the nursing home did not immediately call the paramedics. Several hours later the paramedics arrived and transported her to Pacifica Hospital. She remained in Pacifica Hospital for approximately two months. They discharged her with a 104 degree temperature. When her conditioned worsened, we called the ambulance which transported her to the local hospital where they diagnosed her with a contagious disease ABP and Sepsis. She died March 5, 2010 of the disease. Do we have a case?

I am sorry to read about this facts. This indeed sounds like negligence, elder abuse, and wrongful death. Failing to call paramedics and failing to diagnose/treat a routine infection like sepsis are clearly below the standard of care for medical professionals.

Did your mother have bed sores or anything of that nature while in Astoria Nursing and Rehab Center?
