Legal Question in Medical Malpractice in California

Rude, Unknowing Dentist

Went to dentist to have tooth pulled.The tooth next to it was pushed towards my lip.Went back 4 days later with infection,they said nothing was wrong with tooth it wasn't loose.It has been 2 months & I still can't eat,brush my teeth on that side & it still hurts.(have to use clothe)Complained to Medi-cal,told them I am not going back to them.Found another dentist,they tried to get my xrays,they told them no,said I was still their patient & hung up on them.Can they legally keep my xrays & keep me from going to another dentist.That dentist decided they didn't want to handle this & referred me to another dentist.I was told to file a Formal Complaint with Denti-cal.If I do will I be able to find a dentist that will take me?Or will they be afraid to take me because of me filing the complaint? I need to know because that side of my mouth is hurting.

You have the right to acquire a copy of your records and x-rays, but must pay for them (the statute provides the limits on what can be charged) and they must be provided within 10 days of demand. Even without the records and x-rays, you need to have another dentist examine and treat you if necessary. Clear it with Denti-cal first.
