Legal Question in Medical Malpractice in California

Weird Judge

I am suing an eye doctor by myself. My left eye retina was injured beyond repair, left eye was blind and other injuries. I have evidances of picture of injured retina and treating doctors' medical records.

The Judge loved defendant's counsel and hated me at first court appearance. This judge's manner, attitude encourged Defendant's counsel used female attractions as far as she could, and lied in court, forgery, perjury. This Judge granted Defendant counsel's Summary Judgment against me and ordered Defendant's counsel to propose Judgment with amount. Defendant's counsel knew judge was unfair, she propoed a judgment without money amount. I made an opposition to Defendant's proposed judgment and asked judge to order an award to me. Last week, fifteen days past, I had not heard anything from court, nor from the defendant's counsel. I called Clerk of Court, she said because I opposited the proposed judgment, judge had not ruled it.

Today is twenty-one days. Do you know what Judge is waiting for? Do You think this judge going to do something affecting my right of appeal?

Your response will be gratefull

Susan

Re: Weird Judge

Abe Lincoln said that a man that represents himself has a fool for a lawyer. Never is that more true than in medical malpractice. Your interpretation of events is too bizarre to be true. You need to get the case reviewed by a qualified med mal lawyer now. Otherwise you lose. You cannot prevail in medical malpractice without expert testimony supporting your position. Blindness in one eye is a big injury, but it is not necessarily compensable unless it was caused by professional negligence.

It may not be too late to save this case, if there was a viable case in the first place, but you will not succeed on your own.

Legal fees in a med mal case are always on contingency, meaning there are no fees if there is no recovery.

Re: Weird Judge

I'd be interested in the judge's name, as i have been before judges that have made arbitrary decisions before. However, I need more information to determine whether or not the summary judgment was proper. Call me directly at (619) 222-3504.
