Legal Question in Military Law in California

Obtaining an ID for son

My ex lives in Oregon and is in the National Guard. He refuses to send our 14 y.o. son his military ID. Can I get one here in California and how can I make my ex sign the paperwork to get my son his ID. I also have a court order that my ex is suppose to furinsh Medical Insurance when available with his employer. He has been activated now for over a year as full time and since I have no ID for my son, I cant utilize the medical insurance. What do you suggest I do?

Re: Obtaining an ID for son

If your son is a recognized dependant of an active duty military member he has a right to ID/medical benefits etc.

Begin by writing a letter to your ex, clearly spelling out the issue. Keep a copy and send it certified w/ return receipt recept requested to your ex so that you have proof of what was said and done. Your husband's personnel office should issue an ID card form, which when signed and mailed to you can be taken to any military base ID card office to issue the ID card for your son and enroll him in the DEERS system.

If this does not work, you will need to take more formal legal action.

I am a retired US Military Judge now in private practice and have experience in obtaining medical and military benefits for dependants. Please contact my office if you are intersted in pursuing this option. Our phone number is (619) 238-6000.
