Legal Question in Personal Injury in California

My father works for the postal service in California. He was bitten by a dog last week which required 40 stitches. The dog belonged to the tenant of a property and when my dad consulted an attorney he was advised that he probably would not be able to collect pain and suffereing because he could not prove that the landowner was aware of the animal on the premises. The post office says they are not responsible for anything other than his legal bills and made him return to work on the following day. Does my dad have any recourse?

The dog owner has liability for the harm his dog caused if you can show he knew or should have known of the dog's vicious propensities.

Surely your father has medical insurance through his employment which will pay his medical bills?

I am unaware of the PO's policy of paying legal expenses. I question whether or not you have received accurate information on this point.

I agree that collecting from the landlord is difficult or impossible if you cannot prove he knew of and approved of the dog residing on the premises, and knew or should have know that it was vicious.
