Food Allergy / Restaurant Negligence

I recently experienced an allergic reaction to shellfish during dinner at a very prominent hotel chain. Before eating the entree, I explicitly asked the catering Manager if it contained any shellfish. He assured me that it did not. What type of action can I take against the hotel. Their third party adminstrators have just sent me a letter asking that I call them to ''discuss'' the incident.

Of course it'll be your word against the waiter's word, unless you have witness(es). I'd call the claim adjuster back and tell him what your bills are to date. And how much you want to settle the matter.

The legal action you can take against the hotel can include medical bills, wage loss (if any) and pain & suffering. You can contact the claim administrator to see what their position is at this time and what further information or investigation they would need to conclude the matter. If you had medical bills and missed work, you would need to send them copies of your bills and other verification of any other losses.
