Legal Question in Personal Injury in California

Hi,

i am hit with a demurrer to my first amended complaint due to lack of statutory basis, and violation of codes. i have fixed the complaint, and want to know how and which motion can i file for overruling of the demurrer. Can i submit additional documents supporting my previous complaint? or how much is the fee? Thank you

You need to file an Opposition to the demurrer, asking that the demurrer be overruled and stating the reasons therefor. If you wish to amend the complaint again, you should tell the Judge in the Opposition that you wish to do so; it is in the Judge's discretion so you should give your strongest arguments as to why the demurrer should be overruled.
