my husband was going to receive a personal injury settlement then he died from unrelated accident will the insurance company have to pay me his surviving spouse?

It depends. Did he sign the settlement agreement and release of liability. Did he have a will? Are there any other heirs at law? Was lawsuit filed? Where there any liens on the case?

The right to collect for personal injuries normally expires with the death of the person. But you might be able to collect, if a settlement had already been reached, etc. You need to present an attrney with more information to determine what you can collect.
