Legal Question in Personal Injury in California

This is hypothetically speaking. A driver was talking on the phone while driving and hit a car. One of the two passengers died on impact, the other suffered minor whiplash and various fractures. What would the charges be and what sentence would he get?

Neither of the two passengers are minors. The driver passed a breathalyzer test and wasn't on any drugs or medication at the time.

You do not mention speed, there would not likely be whiplash if bones are fractured, and there is other information lacking. This is a criminal law case but no one will answer unless it is a real case.
