Legal Question in Personal Injury in California

Injured changing a flat tire

I had a flat tire on my 2004 silverado, and I went to get the spare tire out from under my truck and it became stuck, I went under the truck and tried to remove the tire manually when a spring shot out from the car, hitting me in the face, knocking out 3 of my teeth, and shattering the upperbone in my mouth. This has put me through quite a bit of pain physically because the damage it did to my mouth and emotionally because of the embarrassment I have had to go through with missing 3 of my front teeth at age 18. Should I pursue legal action?

Re: Injured changing a flat tire

This types of cases are called products liability and they are very expensive to litigate. Ordinarily a lawyer will conduct burden - benefit assessment very carefully before taking on a case like that.

What was not clear from your message was the extent of the damages. Did you need surgery? was there a permanent damage? are there future medical care and expenses indicated? why did the spring hit you in the face? was there some type of defect or it was your mishandling?

These are questions that I need to know before advising you on any action. Lastly, you have two years in California for this type of case. So, be careful and good luck.
