Legal Question in Personal Injury in California

Liability Insurance

Recently l was involved in a 3 car collision on Hwy 94 in San Diego. A car in front of me spun out of control(Heavy Rain) & struck the car alongside me,which in turn hit my car,smashing my vehicle in the metal barrier totaling it.The driver of the car which first lost control then fled the scene.

Now the insurance Co. for the driver he hit me is claiming their insured was not at fault as she did not cause the accident.They clain that there is no way l can prove their client hit me & its probable l was hit by the Hit & Run driver, so they are not prepared to compensate me. l do not have collision coverage.

Your advice would be greatly appreciated.

That is correct. the car next to you did not cause the accident.
