Legal Question in Personal Injury in California

My accident case was settled. If, a rather lien is purchased by defendant is it still added to gross recovery in accident case to calculate attorney fees percentage? I am referring to a provider lien, not workers' comp lien. Or gross recovery does not include this purchased lien and attorney gets his 40% from gross without the purchased lien added?

It depends on what your retainer agreement says. Some are based on net recovery, others based on gross. If it's silent, and you are dissatisfied, make your point of view known in writing to your attorney. If you remain dissatisfied with the result, you're entitled to go to a non-binding arbitration of the fee dispute.
