Legal Question in Personal Injury in California

Personal Injury

In December, 2005, I slipped and fell at The Southwest Regional Airport in Fort Myers, Florida after disembarking from an American Airlines Flight from California. I slipped and fell on a spill that was not properly cleaned up (there was a yellow cone, but it was behind a pillar, and not visible to me).

I have a lawyer in Florida, who is trying to settle the case with Lee County Port Authority. I just received the Settlement Distribution offer from the lawyer and have a couple of questions.

1) The Florida lawyer is suing Triangle Aviation Services, who services the cleaning of the Airport through the Lee County Port Authority. Should they have sued American Airlines, too (as I flew on them from California)? I am in constant pain since the accident and don't feel like I am going to be adequately compensated, but I need the money now in order to go through more therapy.

2) In the state of California, what is the typical amount that one's medical bills should be reduced in settlement offers (I have Kaiser insurance, and they are offering to reduce my bill by 1/2)? Is that the usual? The medical bill still seems high to me.

Your answers would be greatly appreciated!!!

Thank you very much,

Barbara
