Legal Question in Personal Injury in California

My son was coming home from his wedding rehearsal and two of his cousins were waiting for him at my house. When my son got out of the car, one of the cousins struck him several times closing one of his eyes. The cousin is a two time golden glove amateur boxing champion and is active duty in the Marines. We filed charges but it has been close to three weeks and we have not heard anything. My son wants his cousin to pay for all medical and might need surgery on his shoulder. If my son persues charges will his cousin be dismissed from the marines?

I am not familiar with military procedures. However, your son may file a small claims case against his cousin for the medical costs and pain and suffering if under $7,500. Otherwise he could file a limited jurisdiction civil case.

You need to contact the Marine Corp to see what their policy is. Since he is a boxer, the cousin's hands might be considered a deadly weapon.
