Legal Question in Personal Injury in California

Someone is stalking and harrassing me

For the past 12 months, my ex-boyfriend has been stalking me and harrassing me. He has poisoned me while I was pregnant, stolen my car, flatened my tires 5 times, drained the oil from my car, put sugar in my gas tank twice, ruined my condenser, keyed my car, stole everything I owned from a storage unit, threatened that he is not done with me, physically assaulted me in my driveway, threatned to kill me and my son, committed a hit and run on my brother's vehicle and continues to make threatening statements that he's going to continue. I finally was given a restraining order in Sept. 2003, but I fear he is not done. He has not been prosecuted at all (not even questioned for the most part)and I want to know if there is a way I can file a civil suit against him, what that entails and what are my chances of winning?

Re: Someone is stalking and harrassing me

You could probably sue him for infliction of emotional distress and possibly of the causes of action. However, unless he has money or assets you will gain little for the physical and emotional strain that is involved in litigation.

You may want to consider contacting the local domestic violence advocacy group and ask for assistance in your case. The local press may also be interested in reporting your circumstances.

You may have a civil rights violation cause of action against the local law enforcement agency and or district attorney for failing to take action to protect you from this person.

If the above is not successful than contact the FBI and report the situation.

To begin with, I am hopeful you reported each and every incident to the police and asked that they make a report. Yes you can file a civil suit and it should be done sooner than later. Call to discuss. Don Holben 800-685-6950
