Legal Question in Personal Injury in California

The state of CA [Dept of Motor Vehicles] has always proclaimed that "driving in CA in a privledge - not a right." I always wondered why their position was never tested in the courts - because it's obvious that the motor vehicle was operated here in CA long before DMV regulations were ever implemented.
