Legal Question in Personal Injury in California

I'm a injuried worker that has been diagnosed with bi-lateral carpal tunnel. I had to fight my work on compensation and went under investigation to determine if it in fact is a work injury. Well I won that after 3 months and then finally was able to get proper treatment. i've endured alot of stress and emotional ups and downs from my issues which in fact has affected my children. Like right now I have help with this by my daughters hands. To the point, i was realesed to go back to work now. My only problem is I'm having issues with my hands even after surgery and this was told doctor. From the 1st surgery to the 2nd surgery I've had 9 weeks of healing for my left hand. I''ve only had 4 Physical Therapy sessions for this hand. mY 2nd hand is only 2 weeks into healing and haven't recieved therapy yet. I'm suppose to return to work on 7/16/07 my line of work is being a 2's pre-school teacher which I use my hands alot. the physical therapist and I both feel that if I return to work now it will be too soon and more problems may occur since I'm having issues now. the orthopedic surgeon is great but also works for the insurance/workers comp. Do I have to return to work so quickly after surgery or can i fight this. Do I have a case

I'd also be interested to hear how the injury occured since you state that there was difficuly in establishing that the injury occured on the job. Maybe there is a theory for third party liability as well.

I agree with Mr. Roth. You need a worker's compensation specialist.

Since your zip code indicates you live in San Jose, you might want to check the State Bar's lawyer referral service for a local attorney who will do a good job for you in worker's compensation.

You need to hire a workers compensation attorney now. You can find one by searching for CAAA on google and looking at their website.
