i acquired a house in victorville california in september and the old owner doesnt want to move out. can i legally have him kicked out considering he was never a tenant

Yes. First you would serve a three-day notice to quit. If he doesn't move within that period, then file an unlawful detainer (eviction) lawsuit in the court that handles the county in which the property is situated. You might be wise to consult with an attorney to make sure you dot your "i"s and cross your "t"s. It would be delay things if it were rejected on a technicality.
