active military - foreclosing home

im an active duty and by Jan. our mortgage will be as high as $5500, now were planning to buy another house that we can better afford and let our current home be foreclosed. What's the law governing that? whats the law governing that? will i be charged of fraud? or what will military do to me?

It's not fraud. Af for the military response, if any, I think they will consider it a non-military issue, but, I am no expert on Military Law.
