Legal Question in Real Estate Law in California

My brother and i are co-trustees of a trust with a condo in the trust, the condo is for sale , and pd in full, only expenses are the hoa which is 1544.00 per month, high but the cono is a 1.1m condo in west los angeles ca, we are to split the costs equally but the last 3 months he has refused to pay anything and i am burdened with the entire hoa bill, i realize that since the hoa bill is sent to my home and is listed under the trust name co my name that if i only pay my half the trust will go into collections, question is is there anyway to only pay my half and have my brother be billied and respo for only his half,,,,i will continue to pay the entire 1544 month but if i can legal be responsible for only half the amount/ bottom line is i need to pay my half by myself not be penalized for his lack of responsibility thank you for your time

Depending on how the trust was established you can certainly enforce those terms and/or recover any payments made on your brothers behalf. I would need to see the trust documents and the HOA contract to instruct you further.

If you have any further questions feel free to call me or shoot me an email to schedule a free consultation.

Good luck & Thank you for your question!
