Legal Question in Real Estate Law in California

My Case Management Conference has been delayed due to what the court says is a missing page from the original filing.

My lawyer says he sent all pages and the court must have lost it. He subsequently has billed me another 400 dollars to refile. I dont feel its right for me to have to pay this. Can I make the court reimburse me the cost of refiling.?

There is no filing fee for a Case Management Conference Statement. It is what is known as a no-fee filing. The court only reimburses matters involving court filing fees. These are commonly called court costs.

Your attorney is billing you for his attorney's fees. In my personal opinion, you are being overcharged for something that clerical staff could have done in 5 minutes.
