Legal Question in Real Estate Law in California

We gave our landlord 30 days notice that we would be moving out on the 25th of the month. She is refusing to prorate, stating that we have to pay from the 1st to the 1st. She claims that it is in the lease, but it is nowhere to be found. Is this acceptable?

The general California rule is that a month to month tenancy can be terminated with 30 days notice; it does not have to be a particular date. Since you mention a lease, as opposed to a rental agreement, it might not be so simple in your case. An attorney would need to look at your lease to tell you about your situation for sure.
