Legal Question in Real Estate Law in California

general release clause for condominium onwer

Condominium #1001 had a water leakage which damaged the unit located in the lower floor. The owner of condominium #1001 agreed to repair the lower unit but he wants a full and general release so the owner of the lower unit cannot come back and sue him for any additional damages in the future. I need a full and general release clause for this case.

Thanks,

Re: general release clause for condominium onwer

Such a clause could be stated as a waiver of the provisions of Section 1542 of the Civil Code. Then you can cite what the section says, and could state that the parties understand the provision, yet knowingly waive such provision.
