Legal Question in Real Estate Law in California

Homestead Declaration

My wife and I have placed our home in a revocable living family trust. The online homestead declaration forms are for couples. Can we use such a form, or do we need a special form for trusts?

Re: Homestead Declaration

Fill out the form for a couple. Take it along with a blank copy of the form to the recorder's office, and point out to the clerk that the property is in a revocable trust. The clerk will probably accept the couples form, because that's what you are; the fact that the property is in a revocable trust MAY make some difference in the way it should be signed; that's the purpose of having a second blank copy of the form with you, so that you can re-do it to local expectations if necessary.
