I am looking at house in San Diego, Ca. Is the landlord/rental agency responsible for installing a fence around the pool?

I disagree with Mr. Roach. The only law I know of that pertains to swimming pool safety enclosures or other safety devices is limited to pools that are newly built or are remodeled after 2006. So unless the pool was installed or a permit for remodeling was pulled after 2006, no pool safety installations are required. In addition, even if covered by the law, a fence is only one of seven options, of which the landlord or homeowner must install only a minimum of one. So nothing specifically requires a fence.
