Legal Question in Real Estate Law in California

My housemate owns 7% of my house. She pays one half of the expenses, including utilities, taxes & insurance. I am now renting a portion of the house and she believes she is entitled to one half of the rent. My lawyer says she is entitled to 7%. What percentage is she entitled to, if any?

Whatever amount the two of you agreed. All agreements concerning real estate must be in writing to satisfy the requirements of the statute of frauds.

If you have an attorney, I am not clear why you are posting the question to this site? Nobody on this site can answer the question from the brief facts you have provided. Questions an attorney would need answers to include: How it title vested? Is there an agreement between the owners? What does that agreement provide for? Is the agreement in writing, or oral? There are a lot of other facts one would have to analyze to answer this question properly.
