Legal Question in Real Estate Law in California

New Landlord - New Lease Requirement

The building I rent in was purchased and I now have a new landlord. The new landlord required me to move out for a month to renovate the unit. Is there any compensation due me for this required move-out?

Upon completion of the renovations the landlord is requesting that a new lease be signed prior to occupation, which is at a higher rent. Is this new requirement valid, given the fact that I have a current lease under the old landlord?

Re: New Landlord - New Lease Requirement

Your new landlord can ask that you move out, however he should have given you a rent rebate for the time you were not in your apartment.

You are not required to sign a new lease if your existing lease is still in effect ( there is still time remaining on your old lease). The new landlord bought the building with your lease ahead of him, which means your rights to rent the unit at the agreed upon rate are ahead of his rights. Good Luck.

Re: New Landlord - New Lease Requirement

If your old lease does not stipulate that the lease is cancelled upon change of ownership, then it is still in effect as to the new owner. If you were required to move out, he does owe you compensation.
