Liens on real estate

May a non-incorporated, non-registered road association (association of homeowners, using private roads) file a lien against property of member for non-payment of dues? Members have no contract, just a periodic newsletter and meetings.

An elected board of directors exists and allocates funds for road maintenance.

I am not clear what lien you are referring to. If there is an issues with the title to real property, they can bring suit and record a lis pendens against the property. If the association is owed money, it can bring lawsuit and record attachment lien and or abstract of judgment, as the context may allow. You should consult your own attorney to protect your legal rights.
