does it make sense to sue my mortgage lender because they delayed and denied my request for modification because I am so far past due...manily due to their lack of response?

The success rate for borrowers suing their mortgage lenders is very low. Based upon the meager facts given, it sounds to me as though your case would have a very slim chance of success. Lenders are under no obligation to modify loans.
