notice of pendency

IF this is filed and the sale still goes through, what happens to the money is to go to us? will we hae access to it?

Your question does not make sense! If you mean that there is a lis pendens on a proeprty in foreclosure, assuming the lis pendens( also called a notice of pendency of action) was recorded after the loan was made by the foreclosing lender, it will be wiped out and there will be NO MONEY!
