Legal Question in Real Estate Law in California

Is the owner of a Townhouse responsible for any outside wood or wood attachements ie; a planter box that was placed by the builder? I know that the owner owns the ground or lot that is under the townhouse, but I thought the association was responsible for painting and anything outside of the townhouse.
