Legal Question in Real Estate Law in California

I have another question regarding the answer you gave me for my question. Since my ex is paying the $100 per month until August should I wait till he stops making payments or do it now because he is not making the $150 that he had committed to?

Seems more realistic to wait until the payments stop, because filing a lawsuit might cause them to stop, but also keep the statute of limitations in mind (2 years oral, 4 years written) if that could be a factor. Also, there are some other risks in waiting, for example, he might move and be harder to locate for service of process.
