If I was to begin escrow on a condo

in Fullerton, CA, then two days later

had a previous offer accepted at a

much more desirable condo in

Downey,CA which would I be able

to back out of the Fullerton escrow?

It depends upon the contract language in your Fullerton condo purchase, and whether your offer on the Fullerton condo has been fully accepted. Generally, if the offer on the Fullerton condo was accepted, then you have a real problem. You may have other grounds to cancel the Fullerton condo purchase, but you will need to have the documentation on both deals reviewed and some professional advice on how to proceed. This requires a review of the specific documentation of each transaction before anyone can advise you as to what your rights are, and how you may proceed. One other bit of "general" information - you cannot cancel a purchase contract simply because a better deal came along later - I've never seen that language in a purchase agreement.
