Legal Question in Real Estate Law in California

I recently purchased the front unit of a two-unit, two-on-a-lot complex. There is an "official" HOA (CC&Rs;, HOA dues), but between me and the neighbor in the back unit there are no "elected officers" or anything of that sort. During escrow, the termite inspection revealed termite infestation and they recommended fumigation...however, the neighbor in the back unit refused. I've now been there one year and I really feel that the complex should be fumigated. Our garages and decks share a common wall, so i can't tent just my unit. Can I force my neighbor to participate in the fumigation process/costs?
