Legal Question in Real Estate Law in California

out of state legal matters

I have a family matter, that occurred in Texas. It is an old case, however there may be fruad involved. The person handleing the case in Texas, lives in Los Angeles were I live. She had a power of attorney for my mother, but my mother has since died. I am aware that since there is a death involved with the one issuing the giving the power of attroney, no obligation is made to me. I would like to sue for answers, concerning the despotion of the case. There are three involved, (1) the person having the power of attorney, (2) her attorney, and (3) Getty Oil company. My question is, can I sue her here in Los Angeles and the two others, or do I need to her and the two others in Texas where the case was brought?

Re: out of state legal matters

As far as I know, the oil company you mentioned has offices here in Los Angeles -- of course, if their position is adverse to yours, you could be up against their substantial legal and financial resources.

Your possibility of success depends on a number of factors such as what it is you are suing about (you didn't say); what state and/or federal courts have jurisdiction over the parties and the subject matter (again, it depends on who did what to whom, and where, and you didn't say); the resources, if any, available to you to litigate the case; and, finally, the amount of time that has gone by (there are statutes of limitations that will bar your right to recover if a case is not filed in time). It will, of course, be to your advantage to litigate the case here in Los Angeles if possible.

I would be pleased to consult with you in person if you like.
