Can I sue HUD for selling a house with a damaged/dry well?

Under California law, if the seller of the real property that you acquired knew that the unit had problems with it and failed to disclose such known problems to you before close of escrow, you are entitled to sue the seller (HUD) in your matter for your damages. I suggest that you consult with a real estate attorney about your situation for guidance as to how to proceed.

Offhand, I'd say that HUD is probably not liable for failure to disclose a dry well, or well damage. First, how would it know? Second, such events as a well going dry or sustaining damage can happen any time. Speak with a local lawyer, but I'm not too hopeful.
