Legal Question in Sexual Harassment in California

Dating me was part of his plan to steal my commission

I am a licensed Realtor. My business was slow so I agreed to work as an assistant to someone who is very busy. After about 6 weeks we ended up dating each other. It was obvious from beg. to end that I was crazy about him & he didn't like me enough to even let anyone know about us. We worked on a few transactions together and had a verbal agreement that we would be splitting the commission but all the contracts were to have his name as the R.E. Agent. This was (so he said) so that he would will this big award at the end of the year. I willingly agreed. When the commission came in he suddenly had amnesia & couln't understand why I would think that he would share ''his'' commission. On the C.O.E. day of last sale my client called our broker to complain that he did nothing at all except yell at her & I was the Realtor that was there for here. Broker dismissed this call. I quit.

Re: Dating me was part of his plan to steal my commission

Thank you for your posting, and I am sorry to hear about your unfortunate events. Normally for breach of contract cases, you would want to make sure as much as possible was in writing. You can remedy that now, to a certain extent, by beginning at this point to go back and identify any witnesses to the commission sharing agreement, dates, and specifics.

You didn't mention the amount at issue, but if your termination was based upon sexual harassment, you may have a cause of action for your lost wages due to the termination. If you want to give me more specifics, I would be happy to give you a more comprehensive answer.
