Legal Question in Tax Law in California

I'm helping a relative and have heard there's a law enabling disabled folks to file something like a year late with no penalties, fines, etc., but would like to know exactly how this reads ...AND if the individual hasn't filed for tax year 2008, exactly how should they go about doing so? Thanks!

What he needs to do is file his 2008 tax returns. If he does not owe anything, there are no penalties assessed. If there is an amount owing, they will assess a penalty for failure to file and failure to pay on time. He can then request that the penalties be abated due to special circumstances. No guarantee that they will do so, and the reasoning must be fairly strong. They will not abate the interest, because he was earning interest (theoretically) while he retained those funds rather than paying the tax.
