Legal Question in Tax Law in California

married dependent tax question?

my sister got married last february 05 (she is in the process of getting a divorce

which should be final in march 06), she is claimed as a dependent by our father.

she never told our father she got married and does not want if not necessary. i

would like to know if our father is in any kind of danger by not knowing she

was/is married when it comes time to fill out his taxes while still claiming her as

a dependent?

Re: married dependent tax question?

if she does not qualify as a dependent, your father could be liable for taxes, penalties and interest.

Re: married dependent tax question?

He cannot claim her as a dependent unless she actually meets the IRS definition of a dependent, married or not.
