tax evasion?

I pay my ex-wife about $16,000 per year alimony. I recently learned during a spousal support modification that in 2003 and 2004 she did not claim the alimony I paid her as income. What are her consequences for not reporting income on her taxes? Penalties, fines and how long before IRS catches up with her? I claimed the support on my taxes, any cross reference done?

it is likely, but not certain, that the irs will eventually discover the failure to report spousal support as income. in that case the government will assess taxes, interest and penalties.

you should be sure to keep copies of your records, including cancelled checks, to be able to establish that payments were made by you.
