Legal Question in Tax Law in California

My new tax man is not going to have my annual state & federal tax docs ready for me to submit by the deadline -- April 18th. I'm going to the IRS on the 18th to explain, but is there any legal action I can take against this CPA? He's had all my my numbers & receipts for 2 months! Thanks for your reply.
