Legal Question in Traffic Law in California

Unliscenced Driver

Ok, just moved from VA to CA and my liscence is suspended in VA. I was pulled in my girlfriends vehicle he cited me for unliscened driver and uninsured driver. My girlfriend has a CA liscence as of last week. The registration was at home, the officer ran the tags and VIN and found nothing of the car being registered in VA. 30 day hold on vehicle, but the truck is registered and has insurance on it. Is it to the discretion of the officer how long the hold on the car in impound, or mandatory 30 days? Will my girlfriend be able to prove proper documentation to release the vehicle to her being that I am not the rightful owner?

Re: Unliscenced Driver

She can take proof of registration and insurance to the police agency that impounded the vehicle. However, they may not release the vehicle. In California a vehicle can be impounded if it is being driven by an unlicensed driver. It is the responsiblity of the owner to insure that someone driving their vehicle is properly licensed.
