Bicycle hit by uninsured driver in California

My husband was hit by an uninsured driver. The insurance adjuster claims that there might be a problem due to the fact that the driver did not have consent from the insured owner of the car. We do have an atty handling this case but would like to know what we should expect. There is a police report filed. My husband has been on temporary disability since the accident and ammassed thousands in medical bills...Any advice would be GREATLY appreciated.
