caring for ill mom while brother in another state does nothing

My husband and I have cared for his mom for the last 3 years since she became ill. She needs 24 supervision/care. Her other son has no family,lives in another state makes a regular weekly call. We handle all things for her and have given up all extra activities. His brother came to visit and made a copy of her trust. They are equal administrator/executors. all is 50/50. Can we charge the estate for our care and time. She realizes how much we do for her but is afraid she will upset her other son if she changes anything. Now her health has taken a turn for the worst and we are just waiting at her side. we know he will show up when she dies. Can we do anything?

you cant charge the trust after she is gone but she can pay you now for services.
